Registration of Vessels

The Directorate General of Maritime Administration administers the registration of vessels under the Indian flag in accordance with the Merchant Shipping Act, 2025, and the Merchant Shipping (Registration of Vessels) Rules, 2026. Registration confers legal identity, nationality, and the full protection of Indian law upon every vessel flying the Indian Tricolour.

6 Key Advantages

Registration of a vessel under the Indian flag is not merely a statutory obligation. It is a strategic decision that confers significant legal, commercial, and operational advantages upon shipowners and operators. The following benefits arise directly from registration under the Merchant Shipping Act, 2025, and are reinforced by India's position as a member of the International Maritime Organization with a seat on the IMO Council.

Flag State Protection under UNCLOS

A registered Indian vessel is entitled to fly the Indian flag and receives the full protection of the Indian State on the high seas. The Government of India, as flag State, exercises jurisdiction and control over the vessel in administrative, technical, and social matters as required by the United Nations Convention on the Law of the Sea. This includes diplomatic protection, consular access, and the right to access foreign ports under bilateral maritime agreements.

Clear Legal Title and Ownership

Registration establishes conclusive proof of ownership and nationality of the vessel. The Certificate of Registration and the Register Book, maintained by the Registrar of Indian Vessels at the Mercantile Marine Department, constitute authoritative legal records of title, shareholding, and encumbrances. This clear legal standing is essential for financing, sale, and judicial proceedings, including enforcement of maritime liens, attachment, and arrest of vessels.

Access to Ship Financing and Mortgages

Registered Indian vessels can be mortgaged under the provisions of the Merchant Shipping Act, 2025, creating a secure and publicly recorded charge in favour of financial institutions and banks. Mortgage entries in the Register Book give mortgagees priority recognised in law. This access to structured, legally enforceable ship finance is a cornerstone of fleet expansion and is available only to vessels carrying valid certificates of registration under the Indian flag.

Preferential Rights in Indian Trade

Indian-flagged vessels enjoy statutory preferences in the carriage of certain categories of government cargo, defence cargoes, and public sector shipments under applicable policies. Registered vessels are also eligible to participate in cabotage trade, which is the carriage of cargo and passengers between Indian ports, a right reserved for Indian-flag vessels. These commercial privileges represent substantial earning opportunities not available to foreign-flag operators.

Compliance with International Conventions

Registration under the Indian flag brings the vessel within the regulatory framework of the International Maritime Organization conventions to which India is a party, including SOLAS, MARPOL, STCW, MLC 2006, and the Load Line Convention. The flag State obligations of India ensure that registered vessels carry valid statutory certificates, undergo regular surveys, and satisfy port State control inspections globally, enhancing their commercial acceptability and reducing the risk of detention.

Streamlined Regulatory Interface

The Merchant Shipping (Registration of Vessels) Rules, 2026, have been designed with ease of compliance as a central objective. The entire registration process is conducted online through the eSamudra portal. Standardised checklists, prescribed statutory forms, defined timelines under the Citizen Charter, and a three-tier grievance redressal mechanism ensure that the regulatory interface is transparent, accountable, and time-bound. The Directorate General of Maritime Administration processes registration applications within two working days of receipt of a complete application.

How to Register Your Vessel

Name Approval and Identifier Allotment

Submit an application electronically to the Registrar of the intended port of registry at least seven days before the desired date of registration. The Registrar allots the vessel name, Official Number, MMSI, Call Sign, and IMO number. The allotment is valid for two years. Fees: Rs. 10,000 for first application.

Carving, Marking and Survey

The Registrar issues a Carving and Marking Note. The vessel's name, port of registry, Official Number, and registered tonnage are physically marked on the hull and the navigation bridge brass plate. A Certificate of Survey is issued by the MMD Surveyor or a Recognised Organisation after physical verification of the vessel's particulars.

Submission of Documents and Declaration

The owner or authorised signatory submits Form 5 (Application for Certificate of Registration) along with the Declaration of Ownership (Form 3), ownership documents, and scenario-specific documents such as the Builder's Certificate for new vessels or the Deletion Certificate and Protocol of Delivery for second-hand vessels. Original documents must be submitted within 30 days of the online application.

Issuance of Certificate of Registration

Upon verification of a complete application and all prescribed documents, the Registrar issues the Certificate of Registration (Form 9) within two working days. The certificate may be issued digitally and downloaded from the eSamudra portal, or collected in person. A Provisional Certificate (Form 10, valid for six months) is issued where the Deletion Certificate from the previous flag is unavailable. Registration fees are computed at Rs. 2.50 per GT, subject to a minimum of Rs. 5,000 and a maximum of Rs. 2,00,000.

Important: All timelines under the Citizen Charter are computed from the date of receipt of a complete application, which means that all requisite documents are submitted and the applicable fees are duly paid. Incomplete applications shall not be treated as received for the purposes of the Citizen Charter timelines.

Grievance Redressal

Grievance Redressal Mechanism

3-Level Hierarchy

Any applicant aggrieved by any service delivered or refused under the Citizen Charter may seek redressal through the following three-level hierarchy. Appeals at each level must be made within the prescribed timeframes from the date of the preceding decision or from the date of the service or refusal at Level I.

Level I

Registrar of Indian Vessels, Mercantile Marine Department

First point of redress for all grievances relating to registration services. Application must be made within fourteen working days of the service or refusal at the concerned MMD.

Level II

Nautical Adviser, Directorate General of Maritime Administration, Mumbai

Appeal against the response at Level I. Application must be made within ten working days of the response to the Level I appeal.

Level III

Director General of Maritime Administration (DGMA), Mumbai

Final redress authority within the Directorate. Application must be made within five working days of the response to the Level II appeal.
